มีที่ดินอยู่ 1 แปลง มีเอกสารสิทธ์ สปก.4-01 ซึ่งมีรายละเอียดดังนี้
ที่ีดินแปลงนี้เป็นมรดกตกทอดจากพ่อ พ่อเสียชีวิตเมื่อปี 2530 ตอนนั้นดิฉันอายุ 1 ขวบ
จากนั้นที่แปลงนี้ได้ถูกใช้ทำการเกษตรและพักอาศัยมาตลอด มีการเสียภาษี ภบท. 5 เท่านั้น
จากนั้นเมื่อปี 2553 มีการขอคำร้องรางวัด และออกเป็นเอกสารสปก. 4-01 ซึ่งที่บ้านเข้าใจว่า
สปก.4-01 สามารถนำไปออกโฉนดได้ ซึ่งเป็นความเข้าใจผิด

ขอสอบถามดังนี้ค่ะ
1. จากการตรวจสอบพบว่าได้ทีพระราชกฤษฎีกากำหนด เขตปฏิรูปที่ดินเมื่อปี 2536 ค่ะ
ไม่แน่ใจว่าที่แปลงนี้อยู่ในเขตปฏิรูปหรือไม่ มีวิธีการตรวจสอบหรือไม่อย่างไรคะ

2. หากตรวจสอบแล้ว ที่ดินแปลงนี้ไม่อยู่ในเขตปฏิรูปที่ดิน ดิฉันสามารถยื่นขอเพิกถอนสปก.และขอยื่นออกโฉนดได้หรือไม่ (ที่ดินฝั่งตรงข้ามบ้านมีโฉนด )

เราอยู่ชนบทที่อยู่อาศัย ที่สวนไม่มีเอกสารสิทธิ์ใดๆ เราก็ทำกินมาตั้งแต่ตั้งบ้านหลายชั่วอายุคนแล้ว พอมีกฎหมายให้ทำ เอกสารสิทธิ์ สปก. บ้านใกล้เรือนเคียงพากันไปใช้สิทธิ์นั้นแต่เราไม่มีสิทธิ์เพราะเราเป็นข้าราชการ ทำโฉนดก็ไม่ได้ อยากทราบว่าจะให้เราครอบครองที่ดินนั้นให้ถูกกฎหมายด้วยเอกสารสิทธิ์ใดคะ

มีหลายครอบครัวมีที่ทำกินน้อย พอลูกเต้าโตหาเงินได้ก็อยากจะซื้อที่ดินเพิ่มจากคนที่เขามีเยอะก็ซื้อไม่ได้เพราะที่ดินแถวนั้นเป็น สปก. 90% บางครอบครัวมีที่ดินเยอะแต่ไม่ค่อยได้ทำกินอยากจะขายก็ขายไม่ได้ บางครอบครัวมีลูกหลายคนแบ่งกันแล้วได้คนละ 3 ไร่ ก็ไม่พอทำกินเพราะที่นาครึ่งหนึ่งเป็นที่สูงน้ำท่วมไม่ถึงเหลือไว้เป็นที่ทำนาแค่ไร่กว่าซึ่งน้อยมากจึงทำให้ได้ข้าวไม่พอกิน เมื่อมีปัญหาแบบนี้จึงทำให้บางคนอยากซื้อเพิ่มให้มีที่ทำกินให้พอเพียงแต่บางคนอยากขายเพื่อเอาเงินไปลงทุนอย่างอื่นแต่กลับทำไม่ได้สักคนมันก็เลยเกิดความไม่สมดุลย์และเกิดการไม่เท่าเทียมระหว่างคนในเมืองกับคนชนบท คนที่อยู่ใกล้เมืองหรือความเจริญไม่ว่าจะเป็นที่อยู่อาศัย ไร่นาไดถือครอบครอง นส.3 ,โฉนด ซื้อขายได้ตามต้องการ ส่วนคนชนบทไม่ได้ครอบครองอะไรเลยได้แค่ที่ทำกินไม่สามารถทำอะไรได้เลยมันช่างแตกต่างกันมากเหลือเกินทั้งๆที่เป็นคนไทยด้วยกัน กรุณาตอบให้ความกระจ่างและฝากถึงผู้มีอำนาจโปรดให้ความเป็นธรรมด้วยนะคะเราก็อยากมีโอกาสเหมือนคนอื่นๆเช่นกันค่ะ อยากมีที่ดินเป็นของตนเองค่ะ
